OFFICIAL SWEEPSTAKES RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

VOID WHERE PROHIBITED BY LAW.

OFFERED ONLY TO LEGAL RESIDENTS OF THE UNITED STATES (EXCLUDING THE STATES, TERRITORIES, AND JURISDICTIONS LISTED IN SECTION 2 BELOW).

MINIMUM AGE: 18 YEARS OLD FOR LONG-GUN PRIZES; 21 YEARS OLD FOR HANDGUNS, HANDGUN-FRAME FIREARMS, NFA-REGULATED ITEMS, AND ANY ITEM WHOSE TRANSFER IS RESTRICTED TO PERSONS 21 OR OLDER UNDER FEDERAL OR STATE LAW.

All eligible participants who sign up for a webinar at https://caliberdepot.com will be entered into a sweepstakes for the chance to win the product or service that is featured during the webinar. The official sweepstakes rules are as follows:

1. ENTRY PERIOD

The Caliber Depot Sweepstakes (the “Sweepstakes”) is sponsored by Down Range Supply LLC, doing business as Caliber Depot, an Arizona limited liability company (hereinafter, the “Sponsor”). A separate Sweepstakes is conducted for each individual webinar offered by Sponsor. The Entry Period for each webinar begins when that webinar product is made available on the website (notifications sent via email and SMS to opted-in subscribers) and ends once the maximum number of seats for that webinar have been filled (the “Entry Period”). Webinars do not expire on a calendar date; they remain open until all seats are filled.

2. SWEEPSTAKES ELIGIBILITY

The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia (subject to the exclusions below) who are:

18 years of age or older as of the date of entry, where the Prize is a long gun, accessory, optic, ammunition, or other non-age-restricted item, OR
21 years of age or older as of the date of entry, where the Prize is (a) a handgun, (b) a handgun-frame firearm or pistol-caliber firearm restricted to 21+ recipients under federal law, (c) any item regulated by the National Firearms Act (“NFA”) — including but not limited to suppressors/silencers, short-barrel rifles, short-barrel shotguns, machine guns, destructive devices, and any other NFA Title II item — or (d) any other item whose receipt is restricted to persons 21 or older under federal or applicable state law,

and who have a registered user profile on https://caliberdepot.com.

Excluded States, Territories, and Jurisdictions

The Sweepstakes is VOID to residents of, and entries will not be accepted from, the following:

California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, Oregon, Rhode Island, Vermont, and Washington; and the U.S. territories including Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands.

This blanket exclusion exists because of state firearms transfer restrictions (assault-weapon bans, magazine-capacity limits, handgun rosters, permit-to-purchase requirements, and other transfer prohibitions) and state sweepstakes registration/bonding requirements. Additional per-product state exclusions will be disclosed on each individual webinar product page when the specific Prize is restricted in additional jurisdictions (for example, items affected by state-specific assault-weapon bans, magazine capacity limits, NFA-related state laws, or other prize-specific restrictions). It is the entrant’s responsibility to confirm that the specific Prize being offered may lawfully be received in the entrant’s state of residence before entering.

Excluded Persons

The following persons are not eligible to participate in the Sweepstakes: Sponsor; any of Sponsor’s parents, subsidiaries, affiliates, distributors, or advertising and promotion agencies; any participating Federal Firearms License (FFL) dealer involved in fulfilling the Prize; and any employee, officer, director, member, manager, representative, or agent of any of the foregoing persons, and the immediate family members (spouses, siblings, children, parents, and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals.

The Sweepstakes is also void where prohibited or restricted by law. Persons prohibited from possessing firearms under 18 U.S.C. § 922(g) or any applicable state law are not eligible to receive any firearm or ammunition prize. Sponsor may verify eligibility at any time. Sponsor’s decision as to eligibility is final.

3. TO PARTICIPATE

Eligible participants can enter the Sweepstakes by either of the following methods:

Entry Method 1 — Purchase a Webinar Seat

In order to attend the webinar, participants must:

Each webinar is limited to a specific number of seats. The number of seats may vary between webinars and will be disclosed on each webinar’s product page. Registered participants will receive an email confirmation containing the webinar details, including time, date, and streaming link.

If a registered participant is not available to attend the live webinar, a video replay of the webinar will be made available within seven (7) days of the webinar’s completion in the participant’s logged-in account at https://caliberdepot.com/my-account/my-webinars/ for viewing during the period disclosed on the webinar product page.

Entry Method 2 — Mail-In Free Entry

Participants may enter the Sweepstakes free of charge by mailing a postcard or 3″x5″ index card containing all of the required information to the address below. To be valid, each free-entry submission must:

Be hand-printed in ink. Typed, computer-printed, photocopied, mechanically reproduced, label-printed, or pre-printed entries will be disqualified.
Be on a postcard or index card measuring at least 3.5″ x 5″.
Include all of the following, legibly and accurately:
1. Full legal first and last name
2. Complete mailing address (street, city, state, ZIP)
3. Date of birth (mm/dd/yyyy)
4. Email address
5. Phone number
6. The exact name and webinar number of the specific webinar being entered (e.g., “Caliber Depot Sweepstakes — [Webinar Name and Number]“)

One postcard or index card equals one entry. Each free-entry submission is valid only for the specific webinar identified on it. Submissions missing any of the required information, illegible submissions, and submissions not meeting the format requirements above will be disqualified at Sponsor’s sole discretion.

To be valid, free-entry mail submissions must be received by Sponsor before the applicable webinar reaches its maximum capacity. Sponsor is not responsible for late, lost, misdirected, or postage-due mail.

Entry Limits

Limit one (1) free entry per person per webinar. Free entries beyond the first received from any given person, address, or household will be disqualified. Bulk-mailed free entries originating from the same address or mailing house will be disqualified.

Paid entries (Entry Method 1) are limited by the total seat capacity disclosed on each webinar’s product page. Sponsor reserves the right, at its sole discretion, to limit the number of paid entries per person per webinar to prevent abuse, hoarding, or attempts to monopolize a single drawing.

Paid entries and free entries are weighted equally in the random drawing.

Any attempt by any person to use multiple identities, fraudulent transactions, or canceled transactions to gain more entries than permitted by these Official Rules shall result in disqualification at Sponsor’s sole discretion. By participating, entrants warrant and represent that they agree to be bound by these Official Rules and the final decisions of Sponsor. Entry information becomes the exclusive property of Sponsor upon submission. Proof of submission of an entry does not constitute proof of receipt. It is the sole responsibility of the entrant to notify Sponsor in writing if any of their contact information changes during the Sweepstakes.

4. RANDOM DRAWING / ODDS

On the date of the live webinar (participants will be notified via email), Sponsor will select one potential winner by way of a random drawing from among all eligible entries received for that webinar — paid and free combined, with equal weighting. The drawing will be conducted using a verifiable third-party random number generator (such as random.org’s True Random Number Generator) and recorded as part of the live webinar broadcast. Odds of winning depend on the total number of eligible entries received for that webinar.

5. PRIZE

The Sweepstakes winner for each webinar will receive the firearm, accessory, ammunition, optic, or other product featured during that webinar (the “Prize”). The Prize will be procured, administered, and distributed by Sponsor or by a participating FFL dealer designated by Sponsor. The approximate retail value (ARV) of the Prize will be disclosed on each individual webinar product page. Actual value may vary based on shipping, handling, and FFL transfer fees. The winner will not receive cash value or any other form of compensation in lieu of the Prize. No prize transfer is permitted. No other prize substitution will be made, except at Sponsor’s sole discretion due to unavailability, in which case a prize of comparable or greater value will be awarded.

All taxes (including, without limitation, federal, state, and local taxes) and all FFL transfer, shipping, and background-check fees in connection with the Prize, and the reporting consequences thereof, are the sole responsibility of the winner. The Prize winner shall sign and return an IRS Form W-9 within the time period specified by Sponsor, and such winner will receive an IRS Form 1099 issued in his or her name for the actual value of the prize received if required by law.

6. WEBINAR REFUND AND CANCELLATION POLICY

Webinars That Have Not Yet Run

Webinars do not have a fixed end date and remain open until all seats are filled. A paid participant may request a refund of the seat purchase price at any time before the webinar has reached full capacity and the live drawing has begun, by contacting Sponsor at [[email protected]] (confirm support email). Once a webinar has reached full capacity and the live drawing has begun, the seat purchase is final and non-refundable, regardless of whether the participant attends live or watches the replay.

Cancellation by Sponsor

Sponsor reserves the right to cancel or postpone any webinar for any reason, including but not limited to product unavailability, operational issues, regulatory changes, or insufficient enrollment. If Sponsor cancels a webinar that has not yet been drawn:

All paid participants will receive a full refund of the seat purchase price to the original payment method within fourteen (14) business days, OR, at Sponsor’s option and the participant’s election, equivalent store credit toward another webinar or product;
All free-entry participants will be notified that the entry is voided and may resubmit a free-entry postcard for any future webinar at no charge.

If Sponsor must substitute the Prize after a webinar has been drawn (e.g., the originally featured item becomes unavailable from the manufacturer or distributor), Sponsor will substitute a Prize of comparable or greater value, as described in Section 5.

7. WINNER NOTIFICATION / VERIFICATION / ADDITIONAL PRIZE RESTRICTIONS

The potential winner will be notified by email within seven (7) days following the announcement of the potential winner to verify his or her eligibility and ability to accept the Prize. If the potential winner is not available or does not respond within the timeframe stated in the notification, Sponsor will attempt one (1) follow-up notification by phone, after which Sponsor reserves the right to disqualify the potential winner and select an alternate.

The potential winner must complete, electronically sign, and submit a Declaration of Compliance and an IRS Form W-9 within thirty (30) days of the date the notification is sent in order to claim the Prize. The potential winner must reply as instructed to identify himself or herself, confirm eligibility and ability to accept the Prize, and provide complete contact information within such time period, or he or she will be disqualified.

If the potential winner does not respond within the thirty (30) day time period, Sponsor reserves the right to award the Prize to another potential winner by way of another random drawing from the same pool of eligible entries. Sponsor also reserves the right to award the Prize to another potential winner if the initial potential winner does not meet the minimum age requirement to receive the Prize as enforced by federal and/or state law, or is otherwise prohibited from receiving the Prize.

Proof of identity, age, and legal residence may be required to claim the Prize. Any winner or potential winner may be disqualified at Sponsor’s sole discretion if: (a) he or she fails to provide any required information or properly completed documents within the required time period; (b) he or she fails to comply with any of the terms of these Official Rules; or (c) any Prize or prize notification is returned as undeliverable, any voicemail or email message is not timely returned, or any forms sent to potential winner are not timely returned as instructed.

In the event of disqualification, at Sponsor’s sole discretion the Prize may be awarded to an alternate winner selected from among the remaining applicable eligible entries via the means of winner determination described herein, pending verification of eligibility. All prizes will be awarded.

Firearm and Ammunition Prizes — Special Conditions

If the Prize is a firearm, ammunition, or other regulated item:

The Prize will be shipped only to a Federal Firearms License (FFL) dealer in the winner’s state of legal residence, designated by the winner and approved by Sponsor.
The winner must complete all required ATF Form 4473 paperwork and pass all federal and state background checks (including NICS) at the receiving FFL before the Prize is released.
All FFL transfer fees, state-imposed waiting periods, taxes, and any additional state-required permits, licenses, or training are the sole responsibility of the winner.
If the winner cannot lawfully receive the Prize for any reason — including but not limited to failing a background check, residing in a jurisdiction that prohibits the Prize, being under the legal age of receipt, or being a prohibited person under 18 U.S.C. § 922(g) — the winner will be disqualified, and Sponsor reserves the right to select an alternate winner. Sponsor will not, under any circumstances, ship a firearm or ammunition directly to an individual or in violation of any federal, state, or local law. NO EXCEPTIONS.
If the Prize is an NFA-regulated item (e.g., suppressor, short-barrel rifle/shotgun), the winner is responsible for all costs and procedures associated with ATF Form 4 transfer, including the $200 federal tax stamp, fingerprints, photographs, and any required notifications and wait periods. Receipt of an NFA-regulated Prize requires the winner to be 21 or older.

Sponsor will not replace any lost, damaged, or stolen prizes. Prizes are awarded as-is and without warranty of any kind, implied or express, except as required by the manufacturer’s standard warranty. Sponsor will hold all winning entry records for at least sixty (60) days following the completion of each Sweepstakes drawing.

8. WARRANTIES AND REPRESENTATIONS

By participating, entrants warrant and represent that they agree to be bound by these Official Rules and the final decisions of Sponsor. Each entrant represents and warrants that he or she owns or otherwise controls all of the rights to any content submitted as part of the entry; that the content is accurate; that use of the content does not violate the Official Sweepstakes Rules or any rights of a third party and will not cause injury to any person or entity; and that the entrant will indemnify Sponsor, its related entities, and its affiliates for all claims resulting from content the entrant supplies. Entrants further grant Sponsor and its affiliates and sublicensees the right to use the name submitted in connection with such content, if Sponsor chooses. Sponsor has the right to remove or delete any submission, or any part of any submission, if the submission contains false, untrue, obscene, or indecent statements or material, or violates any applicable law, as determined in Sponsor’s sole discretion.

9. GENERAL CONDITIONS

Sponsor, Facebook, Instagram, Rumble, their parents, subsidiaries, affiliates, advertising and promotion agencies, and any wholesalers, retailers, importers, or distributors, together with the employees, officers, directors, members, managers, and agents of each (collectively, the “Releasees”) are not responsible and shall not be liable for: [a] failures or malfunctions of phones, phone lines, telephone systems, or other communications; [b] interrupted or unavailable network, server, or other connections; [c] electronic, hardware, or software malfunctions, failures, or difficulties of any kind, including server malfunction or human error in the processing of entries; [d] failed, garbled, lost, misrouted, or scrambled transmissions; [e] any error, omission, interruption, defect, or delay in any transmission or communication; [f] traffic congestion on the Internet or any technical problem, including injury or damage to entrant’s computer or device; [g] late, lost, incomplete, damaged, or misdirected entries, email messages, or postage-due mail; [h] any condition caused by events beyond Sponsor’s control that may cause the Sweepstakes to be disrupted or corrupted; or [i] printing errors in Sweepstakes or advertising materials.

By entering and participating, entrants agree: [a] to abide by these Official Rules and by the decisions of Sponsor, whose decisions are final and binding; [b] to the use of their names, photographs, testimonials, or other likeness and prize information by Sponsor and its designees for promotional, advertising, and publicity purposes in any media now or hereafter known throughout the universe in perpetuity, without compensation or notice to or further consent of the winner, except where prohibited by law; and [c] to release, discharge, and hold harmless the Releasees from any and all injuries, liability, losses, and damages of any kind resulting from participation in the Sweepstakes or acceptance, use, or misuse of any prize awarded, including without limitation personal injury, death, and property damage.

Failure to comply with the Official Rules may result in disqualification at Sponsor’s sole discretion and selection of an alternate winner. All federal, state, and local laws and regulations apply.

CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR AND ITS DESIGNEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

Internet entries must be made by the entrant only at the authorized Sweepstakes Page https://caliberdepot.com/webinars/ by completing the online entry form, or via the mail-in entry method described above. Entries may not be made by any other individual or entity, and may not originate at any unauthorized internet website or email address, including but not limited to commercial sweepstakes-subscription notification or entering services. Any potential winner who entered by any of the prohibited methods described above will be disqualified, and an alternate winner will be selected.

In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the “authorized account holder” associated with the email account at the time of entry, who must comply with these Official Rules. Potential winners may be required to provide evidence (to Sponsor’s satisfaction) that they are the authorized account holder of the email address associated with a winning entry.

If, for any reason, the Sweepstakes is not capable of running as planned by reason of damage by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical limitations or failures, strikes, industry conditions, bankruptcy or liquidation, marketplace demands, applicable law, unforeseen obstacles, or any other causes that, in the sole opinion of Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole and absolute discretion to cancel, terminate, modify, or suspend all or any part of the Sweepstakes, and to select the applicable winner from among the eligible, non-suspect entries received up to the time of such cancellation, termination, modification, or suspension, or to proceed in such manner as may be deemed fair and equitable by Sponsor in its sole discretion.

IN NO EVENT WILL SPONSOR, FACEBOOK, INSTAGRAM, RUMBLE, OR ANY OTHER PLATFORM ON WHICH THE SWEEPSTAKES IS PROMOTED, THEIR LICENSEES, PARENTS, AFFILIATES, SUBSIDIARIES, RELATED COMPANIES, ADVERTISING OR PROMOTION AGENCIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF YOUR ACCESS TO OR USE OF THE SWEEPSTAKES PAGE OR THE DOWNLOADING OR PRINTING OF MATERIAL FROM THE SWEEPSTAKES PAGE.

WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SWEEPSTAKES PAGE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

10. GOVERNING LAW / DISPUTE RESOLUTION / ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES BINDING INDIVIDUAL ARBITRATION OF DISPUTES AND A WAIVER OF YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL.

Except where prohibited by law, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action or representative proceeding, and exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as those rules may be modified by these Official Rules. Arbitration shall take place in Maricopa County, Arizona, or by remote/virtual hearing at the entrant’s election. The arbitrator’s decision shall be final and binding.

Class Action Waiver. EACH ENTRANT AND SPONSOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THE ENTRANT’S OR SPONSOR’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver. EACH ENTRANT AND SPONSOR WAIVE THE RIGHT TO A JURY TRIAL.

If, despite the foregoing arbitration agreement, any matter is heard in court, exclusive jurisdiction and venue shall lie in the state or federal courts located in Maricopa County, Arizona, and each party consents to personal jurisdiction in such courts.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, the entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules. Under no circumstances will participant be permitted to obtain awards for, and waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, and participant further waives all rights to have damages multiplied or increased.

11. PRIVACY

Information submitted in connection with the Sweepstakes will be treated in accordance with these Official Sweepstakes Rules and Sponsor’s Privacy Policy located at https://caliberdepot.com/privacy-policy/.

12. SEVERABILITY / HEADINGS

If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience of reference and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof.

13. WINNER LIST

The first name, last initial, city, and state of each winner can be requested from Sponsor for approximately sixty (60) days beginning on or about the conclusion of each individual webinar drawing. For a list of winners or for a copy of these Official Sweepstakes Rules, mail a self-addressed stamped envelope to Sponsor at the address below, to be received within sixty (60) days following the applicable drawing.
